Extenuating Circumstances Policy

Overview

Life can come at you fast and unexpectedly, and TIY understands! This Policy covers unforeseen and out of ordinary events “Extenuating Circumstances”, defined below, that impact the Booking or Services. If an Event occurs, please contact TIY Travel immediately, so we can determine if the Policy applies and help you determine next best steps for your situation. 

This Policy is intended to cover those Extenuating Circumstances listed below. TIY Travel highly encourages all Travellers to purchase Travel Insurance for the Booking to insure all situations and timelines.  

What Events Are Covered

This Policy uses the term “Event” to refer to the following situations that occur after Booking, are unforeseen at the time of Booking, and prevent or legally prohibit completion of a Booking.

  1. Changes to government travel requirements. A Government body or agency places a Travel Ban on a country that directly impacts the Booking and results in you being legally unable to travel to the Booking destination or prevents you from returning to your country of residence.
  2. Declared emergencies and epidemics/pandemics. A Government body or agency declares an emergency that directly impacts the Booking and results in you being legally unable to travel to the Booking destination or prevents you from returning to your country of residence
  3. Military action or restrictions. A military organization places a restriction on residents that does not allow travel to the Booking. There is a military action or restriction at the Booking destination that severely impacts safety and the ability to legally travel to the destination.  
  4. Natural disasters. A major natural disaster occurs that impacts Booking, including Hurricanes, Tropical Storms, Earthquakes, Tornados, Wildfires, etc. The Booking is directly impacted due to disruptions to the region of the Booking and Services. Or, the Traveller is physically unable to travel to the Booking due to natural disaster disruptions in the country of origin. 
  5. Medical Emergency Preventing Travel- After the time of Booking, the Traveller has a life impacting medical emergency. Situations that would qualify are listed below. 
    1. Car Accident rendering the traveller disabled and unable to attend the Booking
    2. Life Threatening Diagnosis that requires immediate treatment and renders the traveller unable to attend the Booking
  6. Cancellation by Travel Vendor. A Travel Vendor cancels a Service for the Booking and alternative Services cannot be obtained.  

What Is Not Covered

Everything else. This Policy only allows for cancellations for the Events described above. Everything else is excluded. Examples of situations that this Policy does not allow cancellations for include: 

  • unexpected disease, illness, or injury; 
  • government obligations like jury duty, court appearances or military duties; 
  • travel advisories or other government guidance (that fall short of a complete travel ban or prohibition); 
  • cancellation or rescheduling of an event for which the reservation was made; and 
  • transportation disruptions unrelated to a covered Event like road closures, as well as flight, train, bus and ferry cancellations or delays. Including any weather, crew technological or mechanical disruptions to transportation. 
  • inability to secure home, family, child or pet care for the duration of the Booking

If you cancel a reservation in these cases, the amount refunded (if any) will be determined by our Terms and the Additional Payment Terms.

What Should You Do If You Think This Policy Applies

If an Event occurs that you believe is covered by this Policy, you must reach out in writing to TIY Travel at information@travelifyou.com. To receive a refund or Travel Credit, you must provide evidence that you meet the requirements of Events in this Policy.

Upon reviewing the situation, TIY Travel will respond with the appropriate next steps. If deemed an Event, TIY will refund the Traveller in accordance with the below refund schedule:

  • 31 or more days before the start date of a Booking:
    • Deposit is non-refundable. A refund or Travel Credit is issued for the remaining amount that has been paid to TIY Travel.
  • 30 days or less before the start date of a Booking:
    • Deposit is non-refundable. A refund or Travel Credit will be issued on any amounts that can be refunded pursuant to the cancellation policy set by the Travel Vendor. Any additional amount that is unable to be refunded by the Travel Vendor will be provided to the Traveller in the form of a Travel Credit.  

If TIY Travel determines that the described Event does not meet the Policy requirements, the amount refunded (if any) will be determined by our Terms and the Additional Payment Terms.

TIY Travel reserves the right to review situations on a case-by-case basis and make modifications to the Policy, as deemed necessary.
